Award: 19(b) award of medical benefits and TTD
Accident: P was union pipefitter working on heating and air systems. Respondent provided him with a truck that had Respondent's logo on it. P had special tools in truck for a job P was requested to go to at a specific time to help Respondent make a bid for a job in Chicago. P left to go there from P's home, in the company truck, when he was injured in a head-on collision on the highway.
Arbitrator acknowledged that coming and going rule usually bars accidents on the way to work or home from work. But the traveling employee exception applied, since P proved he spent about 50% of his work time traveling for Respondent. Complete Vending Services, Inc. v. Also, P was driving the company provided truck at the time of the accident. So arbitrator finds it is a work related accident.
