Police office with longstanding history of low back problems cannot get low back problems covered by work comp after rear-ended because only complaint right after accident was upper back pain

Award: NONE.  No causal connection between October 2009 rear-ender accident where P only complained of upper back pain, and was diagnosed with thoracic strain, and March 2010 complaints of lower back pain.  P admitted his lower back was never totally asymptomatic before the accident, going back even to a 1982 lower back surgery.

Accident: P rear ended in traffic, complained initially just of pain between shoulder blades in upper back.

Injury: Lower back

Restrictions:  Doesn't matter
